3. Payment Terms
✔ Invoices are due per the stated terms (e.g., Net 15 or Net 30).
✔ Late payments may result in service delays or additional fees.
✔ Monthly retainers, if applicable, are billed in advance.
4. Intellectual Property
✔ All custom work (websites, graphics, campaigns) is the property of Prestige Marketing Agency until full payment is received.
✔ Upon payment, rights to use the deliverables are transferred to the client, unless otherwise specified in writing.
5. Results Disclaimer
Due to the variable nature of digital marketing and platform algorithms:
✔ We do not guarantee specific rankings, traffic volumes, or revenue outcomes.
✔ Campaign performance may vary based on market conditions, competition, and client cooperation.
6. Termination
✔ Either party may terminate services with 14 days’ written notice.
✔ Outstanding fees must be paid before release of any files or assets.
7. Limitation of Liability
Prestige Marketing Agency is not liable for:
✔ Losses from delayed campaigns or changes in platform policies.
✔ Technical issues on third-party platforms.
✔ Indirect, incidental, or consequential damages.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States.
